Senate Bill 243 (Chapter 304) signed by the governor July 13 and effective August 1 amends the Statutory Trust Act to among other things permit a statutory trust to elect in its certificate of trust not to be created as a separate legal entity and clarify that formation of a statutory trust is valid regardless of the sequence of the written trust instrument and the filing of the certificate of trust.
